HNI FYI #5: How have the new Stark Law and Anti-Kickback Statute Exceptions affected value-based care?

Healthcare providers should thoroughly evaluate the new exceptions to ensure compliance and maximization of opportunities under the Stark Law and AKS.


The Centers for Medicare and Medicaid Services have established new guidelines under the Stark Law and Anti-Kickback Statute (AKS) that allow more flexibility for value-based compensation arrangements.

Becker’s Hospital Review collaborated with VMG Health to educate healthcare providers on how to implement strategies that will enable them to be successful under the new guidelines. One of the strategies they recommended was maximizing value-based care reimbursement through physician alignment. They explained that “understanding how to pay a physician for quality and/or cost savings will be key to maximizing value-based care reimbursement.” (Becker’s Hospital Review)

Value-Based Clinical Academy

It is unsurprising that physician alignment is key to generating savings and higher quality outcomes. Considering that most, if not all, decisions regarding treatment plans and utilization are made by providers, it is critical to educate them on the “why” behind value-based care and best practices/protocols. HNI and the University of Texas Dell School of Medicine have partnered to create the Value-Based Clinical Academy to provide such education. This Academy takes a deep dive into value-based medicine and is focused on the future of hospital medicine. When physicians are familiar with the goals of value-based care and are equipped with the tools to align their care with this model, they are empowered to lower costs and increase quality.
